2. Acceptance of These Terms

By visiting, browsing or using our website, you acknowledge that you have read and understood these Terms and Conditions.

When purchasing a product, you may be asked to confirm your acceptance of the applicable terms before completing your order.

If you do not agree with these Terms, please discontinue using our website and services.

3. Eligibility and Age Restrictions

Our website contains educational content relating to gambling and crash games. Such content is intended for adults aged 18 years and older.

By accessing gambling-related content or purchasing related educational materials, you confirm that you are at least 18 years old.

We do not knowingly provide gambling-related content or products to persons under the age of 18.

4. Nature of Our Content and Services

Phunyuka Bamphethe provides educational and informational material, including:

  • Aviator and crash-game educational content.
  • Articles explaining game mechanics and probability.
  • Discussions about historical results and multiplier patterns.
  • Educational guides and downloadable resources.
  • Videos and other digital media.
  • General gaming discussions and insights.

Our content is provided for educational and informational purposes. It should not be interpreted as financial advice, investment advice, legal advice or a guarantee of gambling outcomes.

5. Gambling Risks and No Guarantees

Gambling involves financial risk. Crash games and similar games involve unpredictable outcomes, and previous results do not determine or guarantee future results.

We do not guarantee:

  • Winning results or financial returns.
  • Specific multipliers or crash outcomes.
  • That any strategy will produce a profit.
  • That historical data can accurately predict future rounds.
  • That using our educational materials will improve a person’s gambling results.

Any examples, calculations, illustrations or historical analyses are provided to explain concepts and should not be treated as instructions to place bets.

You are responsible for your own decisions and should never gamble money you cannot afford to lose.

Only participate in gambling activities that are lawful in your jurisdiction and through appropriately authorised operators where required.

6. Purchases and Digital Products

Our website operates an eCommerce store through which customers may purchase educational guides, PDF documents, downloadable resources and other digital products.

Each product listing will provide relevant information about the product, its contents, price and delivery method before purchase.

Unless otherwise stated:

  • Digital products are supplied electronically.
  • Products are intended for personal educational use.
  • Access or download instructions will be provided after successful payment confirmation.
  • Customers are responsible for ensuring that their devices can open the supplied file formats.

We make reasonable efforts to ensure that digital products are accessible and correspond with their descriptions.

If you experience problems downloading or opening a purchased product, contact us at hello@phunyukabamphethe.co.za for assistance.

7. Pricing and Currency

All prices displayed on our website will be shown in the currency indicated on the relevant product listing, generally South African Rand (ZAR).

Prices may change from time to time. Any price changes will not affect an order that has already been accepted and paid for, except where correction of an obvious pricing error or another lawful remedy is required.

We reserve the right to correct genuine pricing, description or listing errors. If an error affects an order, we will contact the customer to arrange an appropriate resolution.

8. Payment Methods

We may accept payments through the following methods:

  • PayFast: Including supported credit and debit cards, Zapper and other payment methods made available through PayFast.
  • PayPal: Subject to PayPal’s applicable payment terms.
  • Electronic Funds Transfer (EFT): Subject to verification and confirmation that the funds have been received.

All payments must be made in accordance with the instructions provided during checkout.

For EFT transactions, an order may remain pending until the payment has been received and verified.

Submitting proof of payment does not, by itself, constitute confirmation that funds have cleared into our account.

We do not intentionally request or store full payment card details through ordinary website forms or email communications.

9. Order Processing and Confirmation

When you place an order, you will receive an order acknowledgement or confirmation through the contact details supplied during checkout.

An order acknowledgement does not necessarily mean that payment has been successfully processed.

Orders will be processed after the applicable payment has been successfully confirmed.

If we are unable to fulfil an accepted order, we will notify you and arrange an appropriate remedy, including a refund where required.

10. Digital Product Delivery

Digital products are generally delivered through a download link, customer account or email instruction after successful payment confirmation.

Customers are responsible for providing a valid email address and ensuring that they can receive our order and delivery communications.

If a download link does not work or a purchased file is not received, please contact us at hello@phunyukabamphethe.co.za.

We will make reasonable efforts to resolve delivery issues and provide access to products that have been successfully purchased.

11. Refunds, Cancellations and Returns

We aim to treat all customers fairly and handle refund requests in accordance with applicable South African consumer protection legislation, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002, where applicable.

Customers may have statutory rights to cancel transactions or obtain refunds in certain circumstances. Nothing in these Terms is intended to remove or restrict rights that cannot lawfully be excluded.

Refunds or other remedies may be available where:

  • A payment has been processed but the purchased product has not been supplied.
  • A digital product is defective, corrupted or materially different from its advertised description.
  • An order has been incorrectly charged or duplicated.
  • We are unable to fulfil an accepted order.
  • A customer exercises a cancellation or refund right provided by applicable law.

Because digital products can be downloaded or accessed electronically, the circumstances and applicable statutory rules may affect whether a particular cancellation or refund is available.

Where a customer requests a refund, we may ask for the order number and relevant information to investigate the request.

Approved refunds will ordinarily be processed using the original payment method where reasonably possible, subject to the payment provider’s procedures and applicable law.

Nothing in this section limits any rights available to consumers under applicable law.

14. User Accounts

If our website allows you to create an account, you are responsible for keeping your login credentials secure.

You agree to provide accurate information and to update it when necessary.

You must notify us if you suspect that your account has been accessed without your permission.

We may suspend or restrict accounts involved in fraudulent activity, security abuse or serious violations of these Terms, subject to applicable law.

15. Third-Party Services and Links

Our website may contain links to third-party websites, payment services, gaming platforms, social media platforms and other external resources.

These services operate independently of Phunyuka Bamphethe and may have their own terms, privacy policies and operating requirements.

We do not control or guarantee the accuracy, availability, security or legality of third-party websites and services.

Any interaction with a third-party service is undertaken at your own discretion and subject to that provider’s terms.

However, we cannot guarantee uninterrupted access or that all information will always be complete, current or error-free.

Educational content, examples, game features and third-party information may change over time.

We reserve the right to update, modify or discontinue website features and content where reasonably necessary.

To the extent permitted by applicable law, Phunyuka Bamphethe will not be responsible for losses arising from:

  • Decisions made solely on the basis of general educational content.
  • Gambling losses or financial decisions made by users.
  • Unpredictable game outcomes or changes to third-party gaming platforms.
  • Temporary website interruptions or technical failures beyond our reasonable control.
  • Third-party services, websites or payment provider interruptions.
  • Unauthorised access resulting from circumstances beyond our reasonable control, despite reasonable security measures.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable consumer rights and liability that cannot lawfully be excluded.

18. Responsible Gaming

Gambling can cause financial, emotional and social harm.

Our educational materials are not intended to encourage excessive gambling, chasing losses or treating gambling as a source of income.

We encourage users to:

  • Understand the financial risks associated with gambling.
  • Never gamble money needed for essential expenses.
  • Set personal limits and respect them.
  • Avoid gambling when distressed or under pressure.
  • Seek assistance if gambling becomes difficult to control.
